Terms of Service - A1 Tools

1. Introduction

Welcome to A1 Tools, a business and social media management platform provided by A1 Investment Group LLC ("Company", "we", "us", or "our"). By accessing or using this application, you agree to be bound by these Terms of Service.

A1 Tools is designed for field-service businesses and their authorized users to manage business operations including inspections, scheduling, training, inventory, communications, marketing, social media publishing, and customer relationship management.

2. Authorized Use

This application is intended for:

Businesses that have registered for an A1 Tools account
Authorized users acting on behalf of a registered business
Individuals granted access by an account administrator

You may only connect and manage accounts and data that you own or are authorized to manage. Unauthorized access or use of this application is strictly prohibited and may result in suspension of access and/or legal proceedings.

3. User Accounts & Authentication

You are responsible for maintaining the confidentiality of your login credentials
You must not share your account credentials with any other person
You must immediately report any unauthorized use of your account
The Company reserves the right to disable or terminate accounts at any time
Multi-factor authentication may be required for certain features

4. Data Collection & Monitoring

By using A1 Tools, you acknowledge and consent to the following:

Time & Attendance Monitoring:

Clock-in and clock-out times are recorded
Work hours and schedules are tracked
Compliance monitoring may be performed during work hours

Screen Monitoring (Desktop Application):

Periodic screenshots of your screen may be captured at regular intervals during work hours for productivity and compliance purposes
Authorized management personnel may view your screen in real-time during work hours
In certain situations, authorized personnel may remotely control your workstation for training, support, or supervisory purposes
Active window titles and application usage may be collected
All screen monitoring occurs only when you are clocked in and using company devices

Privacy Exclusions: Certain applications are excluded from monitoring. When privacy-excluded applications (such as personal banking or healthcare portals) are in the foreground, their content is hidden from viewers and not captured in screenshots. The list of excluded applications is maintained by company administrators.

Location Services (Mobile Application):

GPS location may be collected for route optimization
Location data is used for job site verification
Location tracking is active only during work activities

All collected data is used solely for business operations, compliance, training, and improving work efficiency. Monitoring data is accessible only to authorized management personnel.

5. Application Features

A1 Tools provides the following capabilities:

Inspection Management: Create, edit, and submit chimney inspection reports; capture and upload photos; generate PDF reports for customers.

Scheduling & Time Management: View work schedules and assignments; clock in/out for time tracking; request time off and view work history.

Training & Certification: Access training materials and study guides; complete certification tests; track training progress.

Communication: Send and receive company messages; view alerts and announcements; contact team members.

Marketing Tools: Email and SMS campaigns; social media management across multiple platforms; content creation and scheduling.

Sunday Boards & Job Tracking: Manage customer relationships; track job progress and status; view boards and assignments.

Inventory Management: Scan and track inventory items; view stock levels and locations; request supplies.

6. Acceptable Use Policy

When using A1 Tools, you agree NOT to:

Use the application for any unlawful purpose
Attempt to gain unauthorized access to any part of the system
Share confidential customer or business information outside the Company
Falsify time records, inspection reports, or other data
Use automated tools or scripts to interact with the application
Reverse engineer, decompile, or modify the application
Upload malicious content or attempt to disrupt service
Use the application for personal or non-work activities
Misuse social media management tools to post unauthorized content

7. Confidentiality

All information accessed through A1 Tools is confidential and proprietary to A1 Investment Group LLC. This includes but is not limited to:

Customer information and contact details
Inspection reports and findings
Business processes and procedures
Pricing and financial information
Employee information
Social media account credentials and analytics
Trade secrets and proprietary methods

You must not disclose confidential information to any third party without explicit written authorization from Company management.

8. Intellectual Property

A1 Tools and all its contents, features, and functionality are owned by A1 Investment Group LLC and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the application solely for authorized business purposes. This license does not include the right to:

Copy, modify, or distribute the application
Create derivative works
Remove any proprietary notices or labels

9. Third-Party Services

A1 Tools integrates with third-party services including but not limited to social media platforms (Facebook, Instagram, Twitter/X, TikTok, YouTube, Pinterest), Google services, Firebase, WordPress, Workiz, and Thumbtack. Use of these integrations is subject to each respective platform's terms of service and privacy policies.

The Company is not responsible for the availability, accuracy, or policies of third-party services.

10. Thumbtack Partner API Integration

A1 Tools connects to Thumbtack through the Thumbtack Partner API so that authorized users can manage Thumbtack leads, customer conversations, and bookings from within A1 Tools. The following terms apply to that integration.

Authorization to connect: You may connect a Thumbtack Pro profile to A1 Tools only if you are an authorized administrator of A1 Investment Group LLC and the profile is owned by, or expressly authorized for management by, A1 Investment Group LLC. Connecting a Thumbtack profile that you do not own or are not authorized to manage is a violation of these Terms and of the Thumbtack API Terms of Use.

Authorization to act on your behalf: By completing the Thumbtack OAuth authorization flow, you authorize A1 Tools to act on the connected profile's behalf, specifically to:

Retrieve leads, projects, business profile information, customer contact details, and conversation history
Receive event notifications for new leads, lead updates, customer messages, and bookings
Send messages and quotes to customers through Thumbtack
Update lead status, negotiation, and booking or appointment information
Synchronize the resulting customer and appointment records with Workiz

This authorization remains in effect until the profile is disconnected in A1 Tools or access is revoked from the Thumbtack account.

Automated and AI-assisted actions: A1 Tools may use automated classification and AI-assisted drafting to categorize Thumbtack leads and prepare suggested replies. You acknowledge that these features assist authorized staff rather than replace them: all automated actions follow business-defined policies, are logged for audit, and remain subject to human review and immediate takeover. You remain responsible for all messages sent from your connected profile, including those originating from an AI-generated draft that you or your staff approve or configure to send.

Acceptable use of Thumbtack data: In addition to Section 6, you agree not to sell, rent, or license Thumbtack data; use it for advertising, ad targeting, or audience building; disclose it to any other business or unauthorized party; use it to contact customers outside the scope of the service they requested; or use it in any manner prohibited by the Thumbtack API Terms of Use. Thumbtack customer data is confidential information under Section 7.

Disconnection and data handling: You may disconnect a Thumbtack profile at any time through A1 Tools settings or by revoking access from your Thumbtack account. On disconnection, stored OAuth tokens are deleted immediately and A1 Tools ceases retrieving Thumbtack data. Retention and deletion of previously received Thumbtack data is described in Section 10 of our Privacy Policy.

Compliance and precedence: Use of the Thumbtack integration is governed by the Thumbtack API Terms of Use, the Thumbtack Terms of Use, and Thumbtack's developer policies, in addition to these Terms. Where these Terms conflict with Thumbtack's terms with respect to Thumbtack data, Thumbtack's terms control. Thumbtack may suspend or terminate API access independently of these Terms, and the Company is not liable for any resulting loss of integration functionality.

11. Disclaimer of Warranties

A1 Tools is provided "as is" and "as available" without warranties of any kind, either express or implied. The Company does not warrant that:

The application will be uninterrupted or error-free
Defects will be corrected in any specific timeframe
The application is free of viruses or harmful components

The Company is not liable for any damages resulting from the use or inability to use the application.

12. Limitation of Liability

To the maximum extent permitted by applicable law, A1 Investment Group LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of A1 Tools, including but not limited to loss of data, loss of profits, or business interruption.

13. Termination

Your access to A1 Tools may be terminated:

Upon termination of your employment or contract
For violation of these Terms of Service
At the Company's sole discretion

Upon termination, you must immediately cease using the application and return any company devices or materials.

14. Changes to Terms

The Company reserves the right to modify these Terms of Service at any time. Continued use of the application after changes constitutes acceptance of the modified terms. Users will be notified of significant changes through the application or company communications.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions.
